Terms of Service
Please read these terms before using CyTide Hosting services.
Australian Consumer Law: Nothing in these terms limits or excludes any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Where the law provides consumer guarantees that cannot be excluded, those guarantees apply.
1. About CyTide Hosting
CyTide Hosting is a sole-operator hosting business based in regional Far North Queensland, Australia, operated by Jack. CyTide Hosting runs on home infrastructure. It is not a commercial data centre.
By using our services, you agree to these Terms of Service. If you do not agree, do not use our services.
2. Services
CyTide Hosting provides the following services:
- Minecraft game server hosting (Purpur/Paper-based)
- Discord bot hosting
All services are managed through a Pterodactyl control panel and hosted on hardware in regional Far North Queensland. Services are subject to availability and may be modified or discontinued with reasonable notice.
3. Accounts and Eligibility
You must be at least 18 years old to create an account and purchase services. By registering, you confirm all information you provide is accurate and that you are legally capable of entering a binding agreement.
You are responsible for keeping your account credentials secure. We are not liable for loss arising from unauthorised access to your account. Each account is for a single individual or entity. Sharing accounts is not permitted.
4. Payments and Billing
All prices are in Australian Dollars (AUD). GST does not currently apply as CyTide is not registered for GST (ABN registration pending). Payments are handled through the Client Portal. Card details are processed by our billing provider and are never stored on CyTide's own infrastructure.
Services are billed monthly. Failure to pay may result in service suspension and eventual termination with notice.
Goodwill Refund Policy: If you request a refund within 14 days of your first payment and the service has not been significantly used, we will provide a full refund as a goodwill gesture. This is in addition to any rights you have under the Australian Consumer Law. Refunds after 14 days are assessed on a case-by-case basis and will not be issued for periods where the service was available and functioning normally.
5. Uptime and Service Availability
CyTide Hosting does not guarantee any level of uptime or service availability. Services run on home hardware and are subject to unplanned interruptions including power outages, ISP incidents, and hardware failures.
We operate redundant networking with a 5G cellular backup alongside the primary fibre connection. If the failover activates, the service may remain online but speeds may be significantly reduced. A brief interruption during switchover is also possible.
Outage notifications are communicated in the CyTide Discord. Monitoring is handled by an independent third-party service outside CyTide's network, so status updates are accurate even when the node is offline.
6. Backups and Data
CyTide runs daily automated snapshots to a dedicated on-site drive for disaster recovery purposes. These are not customer-restorable. They exist for catastrophic events such as drive failure and are restored by CyTide. Separately, Pterodactyl provides in-panel backup tools that customers can use to create and restore their own backups at any time. There are no off-site backups.
We strongly recommend all customers use the in-panel backup tools regularly and maintain their own SFTP downloads of critical data. CyTide Hosting accepts no liability for data loss where the customer has not maintained their own backups.
7. Acceptable Use
You agree not to use CyTide Hosting services for:
- Hosting or distributing illegal content under Australian law
- Conducting or facilitating DDoS attacks or network abuse
- Running cryptocurrency mining software
- Hosting content that infringes third-party intellectual property rights
- Running tools designed to exploit or attack other services
- Any activity that violates the terms of third-party software on your server (including Minecraft EULA)
- Storing or distributing malware or malicious software
Violations may result in immediate termination without refund. Where illegal activity is suspected, CyTide Hosting reserves the right to cooperate with law enforcement.
8. Cancellation and Termination
You may cancel at any time through the Client Portal. Cancellation takes effect at the end of the current billing period and you retain access until that date.
Upon cancellation, you have 7 days to download your server files via SFTP. After that period, server data will be permanently deleted. If CyTide Hosting ceases to operate, all customers will receive advance notice, a full export of their data, and a pro-rated refund for unused prepaid time.
9. Limitation of Liability
To the maximum extent permitted by Australian law, CyTide Hosting's total liability for any claim shall not exceed the total amount paid by you in the 30 days preceding the event. We are not liable for indirect or consequential loss, except to the extent required by Australian Consumer Law.
10. Changes to These Terms
We may update these terms from time to time. Changes will be announced in the Discord server with at least 14 days' notice. Continued use of services after the effective date constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Queensland. Nothing in these terms limits any rights you have under the Australian Consumer Law.
